Adopting mediation early on in a dispute can be one of the wisest decisions you'll ever make; you'll have the best possible opportunity to avoid lengthy and costly processes arising from escalation.  It's normally in everybody's best interest to resolve issues but if attempts are not successful courts are more likely to look favourably on cost applications when a party has entered mediation and attempted to resolve issues.   

The success rate of our mediation process is very high-over 90% settlement rate to the satisfaction of all parties.

Process:

We like to prepare well.  A series of pre-mediation phone calls can often result in new information starting to create paths of agreement before the mediation even occurs.  We arrange a suitable meeting place convenient for all parties with as many meeting rooms as are necessary (usually three).  We normally allow a period from 9:30 until 16:00 with a lunch break to find resolutions and then create a settlement contract.  Your legal support can attend the mediation as can other support. 

We meet together first to establish ground rules and then have a series of private meetings to discuss potential routes for the day culminating in a group meeting.  This is flexible of course depending on the particuar situation. 

As mediatiors we remain impartial and our position is to facilitate agreement paths but we won't sit on the fence either.  There are ground rules to be set and adhered to which allow for the most productive day. 

Conflict and Discomfort:

Our methods promote a non confrontational session keeping everybody as comfortable as possible.  Often there is substantial anxiety with deeply ingrained views and we like to try to eliminate these feelings prior to and on the meeting day. 

Confidentiality and Without Prejudice:

The process will be completely confidential as will the seperate meetings with the mediator only sharing information you agree to reveal.  Nothing said during the mediation can be used in court at a later date which encourages openness and production of new ideas and solutions.
